What Legislation in Ontario applies to EV Charging for Condos?


    1. Condominium Act, 1998

 

The Ministry of Government and Consumer Services (MGCS) introduced amendments to Condominium Act, 1998 which came into effect May 1, 2018.   The amendments set out the processes for:

  • condominium corporations to obtain approval to install EVCS’s
  • an owner to request and obtain approval to install an EVCS

    1. Ontario Building Code

Electric Vehicle Supply Equipment is defined as the complete assembly consisting of conductors, connectors, devices, apparatus, and fittings installed specifically for the purpose of power transfer and information exchange between the branch circuit and the electric vehicle.

Legislation identical to workplace charging requirements (already effective) is proposed for multi-unit residential buildings:

        • Where parking spaces are provided inside the building, at least 20% of the parking spaces would need to be provided with EVSE
        • The remaining parking spaces would need to be “EV ready”

 

The Building Code does not specify the level of charger required for compliance, however:

        • Regardless of Level, all the code for new construction requires all EVSE components to be included (cannot simply provide a power outlet for Level 1 chargers)
        • Level 1 charging will not typically be sufficient for a full overnight charge
        • The spirit of the code entails Level 2 chargers
